Summary of Privacy Policy

This Privacy Policy offers you an overview of how your data is processed, who is responsible for your data processing, protection, defining what exactly Personal Data is, what your rights regarding your Personal Data processing are, what types of Personal Data Parcent collects. This Privacy Policy defines the manner in which Parcent s.r.o. collects, uses, maintains and discloses information collected from the User of the Evercash Website and Evercash Mobile Application.

The goal of this Privacy Policy is to protect rights and freedoms of Users in connection with their Personal Data processing by Parcent s.r.o.

This Privacy Policy is prepared in accordance with European Union General Data Protection Regulation (GDPR).

This Privacy Policy defines key purposes and principles of User’s Personal Data processing, storage period and lawfulness of processing, cases where Personal Data is transferred to third parties, and security measures.

This Privacy Policy contains instructions and contact details, pursuant to which the User may exercise his rights and file complaints.

This Privacy Policy describes Parcent’s cookie policy. The cookie policy is also available on the Mobile App .

Parcent s.r.o. strictly follows industry best practices and adheres to the rules provided for by the applicable legislation.

This Privacy Policy Mobile App lies to the Website, Mobile App , and all Services offered by Parcent s.r.o., doing business as “Evercash”.

Definitions

Parcent s.r.o. is a limited liability company (reg. No 17221684) registered in Czechia with its registration address at sídlem Osadní 869/32, Holešovice, 170 00 Praha 7, Czechia. Parcent s.r.o. operates and provides virtual currency services under the Czech Trade Register, issued by the Czech Trade Register (REGISTR ŽIVNOSTENSKÉHO PODNIKÁNÍ – ID RZP: 144936763). Evercash is the tradename of Parcent s.r.o. (hereinafter also “Parcent”, “we”, “us”, “our”, “Evercash”).

User means Evercash customer, a natural person (hereinafter also “you”, “your”).

User Account means a user account accessible via the Website and Mobile App where funds may be stored by Parcent on behalf of a user, under the name of “Evercash”.

GDPR means European Union General Data Protection Regulation 2016/679.

Services means Parcent services, which are provided to registered Users. Parcent provides you with a simple and convenient platform for an exchange of digital assets for fiat currency and vice versa, and exchange of a digital asset to any other asset type at the exchange rates established. Services also include holding and transferring digital assets.

Personal Data means any information relating to an identified or identifiable User (natural person) within the meaning of the GDPR.

Website means Evercash Website (http://evercash.eu).

Mobile App means Evercash Mobile Application.

Policy means this Privacy Policy.

Cookies means text files placed on User’s computer or phone to collect standard Internet log information and visitor behaviour information. When User visits the Website and Mobile App, Parcent may collect information from you automatically through cookies or similar technology. For more information about cookies, visit http://www.allaboutcookies.org/.

EU means European Union (Austria, Belgium, Bulgaria, Croatia, Republic of Cyprus, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, Netherlands, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden).

EEA means European Economic Area (EU countries + Iceland, Liechtenstein and Norway)

Third countries mean countries which are not included in EU / EEA.

Third Party Service Providers mean Partners of Parcent which are required to perform the Services.

Personal Data breach means accidental or fraudulent Personal Data loss or unauthorized disclosure.

Principles of data processing

Parcent processes User’s Personal Data in a lawful, fair, and transparent manner. Parcent has developed this Policy by which Users are informed about lawfulness, fairness and transparency of processing.

Processing of Personal Data is adequate, relevant and limited for clear purposes. Parcent doesn’t process Users’ Personal Data for any purpose not described herein.

Personal Data is processed in an accurate manner and kept up to date. Parcent and its employees take every reasonable step to ensure the accuracy of Personal Data processed. If Parcent has any doubt regarding correctness of User’s data, Parcent employee will contact the User regarding User providing Personal Data. Personal Data that are inaccurate will be erased or rectified without delay.

User’s Personal Data is processed for no longer than is necessary for the purposes for which the Personal Data are processed.

Personal Data is processed in a manner that ensures appropriate security of the Personal Data, including protection against unauthorized or unlawful processing and against accidental loss, destruction or damage, using appropriate technical or organizational measures. Parcent protects User’s Personal Data using modern technologies and standards. Access to User’s Personal Data is granted to relevant Parcent employees only.

Categories of Personal Data processed

Personal Data is data, which identifies or may identify User. Parcent collects Personal Data from Users in a variety of ways, including, but not limited to, when Users visit our Website or Mobile App , sign up on the Website or Mobile App , place an order, and in connection with other activities, Services, features or resources we make available on our Website and/or Mobile App .

The categories of Personal Data processed by Parcent are in any case conform to the information provided by the customer provides mainly include:

  • Personal identification data: full name, date of birth, passport or ID number and other details and scan (or photo), citizenship, residence permits, place of birth, taxpayer number, your photographic identification, liveness detection.
  • Contact data: residence address, email address, phone number, other contact information (e.g. Skype, What’s App , etc.);
  • Information obtained through communication with Evercash (information obtained from your emails, telephone conversations (with or without audio recording), contact form inquiries when User contacts Evercash, as well as information about the devices and technologies used by User for communication).
  • User’s financial data: information about the source of income, information about planned transaction volumes, details of User’s bank accounts, details of User’s payment cards, information about User’s digital assets addresses, information about the source of funds, information about User’s transactions, and other data which may be requested from time to time and which is needed to comply with relevant anti-money laundering and combating of terrorism financing legislation.
  • Evercash Website visitor’s information data: browser name, type of computer, IP- address, operating system, Internet service providers utilized, and other similar information.
  • User’s due diligence data (information obtained by Parcent regarding User during onboarding and / or during periodic review): User connection with Politically Exposed Persons, information from public sources, information about User from screening databases, information about activities for which Parcent Services are used, transaction details, and other data which may be requested from time to time and which is needed to comply with relevant anti-money laundering and combating of terrorism financing legislation.
  • Personal Data you provide as part of your User Account with us, including: your password; your Account details and marketing preferences.
  • Personal Data that we collect from third parties in order to be able to register you as a User or to provide Services to you: Personal Data related to payments to or from your Accounts with us, provided by payment processing services, banks, card schemes and other financial services firms; Personal Data from credit reference agencies or fraud prevention agencies.
  • Other Personal Data or commercial and/or identification information: whatever information Parcent, in our sole discretion, deem necessary to comply with our legal obligations under various anti-money laundering (AML) obligations, such as under the European Union’s 4th AML Directive.

Corporate Evercash customers are asked to provide legal entity’s registration data, information about legal entity’s business, financial data (this data is not considered Personal Data). However, information about legal entity’s representatives, owners, beneficial owners contain Personal Data mentioned in clause 4.2 and therefore falls within the scope of this Policy as well.

IMPORTANT: Parcent does not collect or store any information about children under 18. Minors and children should not use our Website, Mobile App and Services. By using our Website, Mobile App and Services, you represent that you have the legal capacity to enter into a binding agreement. Parcent does not process any sensitive personal information, such as racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, genetic data, data concerning health or data concerning a natural person’s sex life or sexual orientation.

Purpose of Personal Data processing

Parcent processes User’s Personal Data only in cases where a specified purpose has been determined for the processing. Parcent doesn’t process data which is not required for achieving legitimate purposes.

Parcent processes Personal Data for:

  • Parcent’s Service provision:
    • User’s onboarding (account opening, user’s identification);
    • User’s periodic review (due diligence);
    • To enable User to complete transactions;
    • Internal business purposes and record keeping;
    • Performing duties in compliance with relevant national and international Anti-Money Laundering and Terrorism Financing Prevention Legislation.
  • Advertising and analytic purposes and to improve Evercash Website/Mobile App and your experience on the Website and Mobile App:
    • To analyze the usage and maintenance of the Website and Mobile App;
    • To remember User’s previously selected preferences on the Website and Mobile App.
  • To reply on your queries, if you contact Parcent:
    • To improve customer service: information provided by Users helps us respond to customer service requests and support needs more efficiently.
  • For market research purposes, analyzing Parcent customers’ needs and opinions on Parcent’s products and Services:
    • Parcent may use feedback provided by Users to improve the products and services;
    • Parcent may use information generally to understand how our Users as a group use the Services;
  • For IT security measures.

Legal framework of Personal Data processing

Parcent s.r.o., doing business as Evercash, operates and provides virtual currency services under the Czech Trade Register, issued by the Czech Trade Register (REGISTR ŽIVNOSTENSKÉHO PODNIKÁNÍ – ID RZP: 144936763). This makes Parcent an obliged entity within the meaning of Czech Act No. 253/2008 Coll. dated June 5, 2008 on Selected Measures Against Legitimization of Proceeds of Crime and Financing of Terrorism. To provide our Services to User, Parcent is obliged to collect and process your Personal Data and allowed to do so under Section 5 of Czech Act No. 110/2019 Coll. of March 12, 2019 on Personal Data processing.

  • Parcent collects Personal Data from Users, who agreed to use Services. If a User agrees to use Services, the User also agrees with Parcent Terms of Use, AML-Policy and Privacy Policy and voluntarily agrees to provide his Personal Data. Services are based on an agreement between User and Parcent s.r.o., which is described in Parcent’s Terms of Use. The collection of Personal Data is also necessary for the performance of the agreement between User and Parcent.
  • Users can always refuse to supply personal identification information, although, this it may prevent them from using our Services.
  • Users may, however, visit Evercash Website homepage anonymously. In this case Website visitor’s information will be collected together with cookies (IP address, browser name, computer type, operating system, other similar information) for purposes defined in clauses 5.2.2. and 5.2.5. Data will be collected if User has given his / her consent. The Cookie Policy is available on the Website.
  • The User can set the browser to not accept cookies, and the Website tells you how to remove cookies from your browser. However, in certain cases, some of Website features may not function as a result.

Personal Data transfer to Third parties and Third countries

In the processing of Personal Data, Evercash respects User’s confidentiality and does not transfer Personal Data to Third parties, except for:

  • During the business relationship with User, the transfer of User’s Personal Data to Third parties is necessary to provide Services.
    • When processing payments – to acquiring and card issuing partners (financial institutions); Evercash may share and transfer your Personal Data to Third party service providers for the purpose of rendering the order made through our Partner’s website via the use of your payment card. The Personal Data will be shared with the Third party service provider after you execute such payment to use the services of the Third party service provider. We do not share this information with side parties except to the extent necessary to provide the Service. Personal Data shall include information that identifies you, including the information submitted by you at the sign-up on Evercash, such as your E-mail address, full name, country and city, and/or information provided through social websites or any other identifying information provided by you while using our Services.
    • To banks or other financial institutions (e. g. in case of a dispute, claim, chargeback, investigation).
    • In case the transfer of User’s Personal Data is required by laws and regulations (e.g. possible inquiries from regulatory officials).
  • Evercash uses cookies of third parties, such as Google, to make advertisements and optimize marketing communication. Third party advertisers use the cookies stored on the device of the homepage visitor to assess the efficiency of the advertisement and personalize the content of advertisements displayed to the Website visitor. Information collected by third party advertisers may include data such as geographical location (derived from the IP address). With cookies, Evercash collects data on how Users use the Website and Mobile App to see what services are important to Users. This helps us to improve our services as well as to offer Users relevant information on social media, Mobile Apps and other websites. Cookie settings can be changed. You can set your browser not to accept cookies, and the Website tells you how to remove cookies from your browser. However, in certain cases, some of our Website features may not function as a result. The Cookie policy is available on the Website and Mobile App, you may choose giving your consent before enabling cookies or similar technologies.

Parcent is processing its Users’ Personal Data within EU / EEA. However, in certain situations, Personal Data might be processed in Third countries. Parcent will not cooperate with partner or authority from Third country, unless the legal basis of processing is determined (e.g. regulatory requirement for entering into or performing contracts, or in accordance with User’s consent), and unless proper security measures are in place. Parcent will differentiate between secure and unsecure Third countries. Secure Third countries are those for which the European Commission has confirmed a suitable level of data protection based on an adequacy decision. In those countries, national laws provide a level of Personal Data protection which is comparable to those of EU law. In case the data recipient is from an unsecure Third country, Parcent ensures in another way that the Personal Data be sufficiently protected by the recipient. This will be ensured through standard contractual clauses, through the commitment to comply with codes of conduct which have been declared by the European Commission as being generally applicable, or by certification of the data processing procedure. Upon request, User has the right to receive more detailed information regarding the Personal Data transfer to Third countries.

Parcent may transfer any Personal Data provided by the User through use of the Parcent Services to the Third Party Service Provider in order to allow the Third Party Service Provider to analyze this information and determine whether User is qualified to use the Services of such Third Party Service Provider (including the history of User’s transactions on the Website which will be provided without any identifying information and solely for the purpose of performing the preliminary examination). All Third Party Service Providers are monitored by Parcent for PCI DSS compliance on annual basis.

Rights of Users

Users have the right to obtain information regarding their Personal Data processing by submitting written request to Parcent by:

  • Sending request for information by email [email protected]. If a request for information is sent by e-mail, Parcent may ask User to provide additional documents for data subject identification.
  • If there is a request from User about his data processing, Parcent will answer to this request within 1 month from date of receipt. If Parcent is unable to provide the answer according User’s request within one month, Parcent may extend the period of providing answer within two months, previously (within one month from request) informing the User about the reasons of such delay. If Parcent will not provide the answer to User, Parcent informs User within one month from the moment of request receipt of the reasons of not providing the answer, in this case User may lodge a complaint to Supervisory authority.
  • User’s request is processed free of charge. If Parcent notices that a User’s requests are submitted repeatedly and are unreasonable or excessive, we may charge a reasonable fee, previously informing the User.

Users have the following rights regarding the processing of their Personal Data:

  • To receive information about User’s Personal Data processing – categories of Personal Data concerned, purposes of processing, recipients or categories of recipients to whom the Personal Data have been or will be disclosed, sources of data which was not collected directly from the User, information about appropriate safeguards if User’s Personal Data are transferred to a Third country or to an international organization.
  • Right to access – you have the right to obtain from us confirmation as to whether or not your Personal Data are being processed, the purposes of the processing, the categories of Personal Data collected, the recipients to whom the Personal Data have been or will be disclosed etc.
  • To request from Evercash rectification or erasure of Personal Data or restriction of processing, and to object to processing, as well as the right to data portability
    • If a User believes that his Personal Data in Evercash profile is incomplete or inaccurate, the User has the right of rectification and may write an e-mail to Evercash support ([email protected]), Evercash support will consider User’s newly provided data and compare them to User’s documents. In some cases, Evercash support may ask for additional documents to verify User’s newly provided data.
    • Users have the right to have their Personal Data erased by Evercash. Evercash shall comply with this request if the Personal Data is not necessary in relation to the purposes for which they were collected or processed, and the mandatory data storage period is expired, or if the User has withdrawn his consent on which the processing is based, unless Evercash has any other purpose and legal basis for the processing. In the two former cases Evercash will delete the data (which is not necessary for the Services and after the data storage period has expired) automatically.
    • Users have the right to block or suppress the processing of Personal Data in certain circumstances such as if you contest the accuracy of that Personal Data or object to Parcent processing it. It will not stop us from storing your Personal Data. We will inform you before we decide not to agree with any requested restriction.
    • In case of User’s Personal Data rectification, erasure or restriction of processing, Parcent will communicate this to each recipient to whom the Personal Data have been disclosed, unless this proves impossible or involves disproportionate effort. Parcent will inform the User about those recipients if the User requests it.
    • You have the right to obtain your Personal Data from Evercash which you have provided to Evercash, in a structured, commonly used and machine-readable format, and have the right to transmit those data to another controller without hindrance from Evercash. The right can be exercised regarding Personal Data provided directly by the User, and regarding Personal Data processed by automated means.
    • User have right to object on grounds relating to your particular situation, at any time to processing of your Personal Data if there are no legitimate grounds for the processing which override your interests, rights and freedoms or for the establishment, exercise or defense of legal claims. User will not be able to exercise this right if User gave consent to the processing of Personal Data, or Parcent requires processing of User’s Personal Data for the establishment and fulfilment of contractual obligations with User.
  • Automated individual decision-making (including profiling) is not envisaged by Parcent. If Parcent will implement automated individual decision-making (including profiling), this data protection policy will be updated, and Users will be informed about the update.

Rights of Users shall not apply to the collection and processing of information, which was obtained for fulfilment of statutory requirements (e.g. obtaining information about User from public sources according to anti money laundering laws and regulations).

Notifications in case of Personal Data breach

When a Personal Data breach is likely to result in a high risk for rights and freedoms of Users, Parcent shall communicate the Personal Data breach to the User without undue delay.

  • Users may not be informed about a data breach if:
    • Parcent has implemented appropriate technical and organizational protection measures, and measures were applied to the Personal Data affected by the Personal Data breach to render the Personal Data unintelligible to any person who is not authorized to access it, e.g. encryption.
    • Parcent has taken subsequent measures which ensure that the high risk for rights and freedoms of Users is no longer likely to materialize.
  • Users may be informed collectively.

9.2 In case of a Personal Data breach, Parcent shall without undue delay and where feasible, within 72 hours after having become aware thereof, notify the Personal Data breach to the Supervisory Authority (Czech Data Protection Inspectorate), unless the Personal Data breach is unlikely to result in a risk for rights and freedoms of individuals. Where the Supervisory Authority is not notified within 72 hours, reasons for the delay should be stated.

Privacy when using digital assets and blockchains

Your funding of bitcoin, ether, and other digital assets, may be recorded on a public blockchain. Public blockchains are distributed ledgers, intended to immutably record transactions across wide networks of computer systems. Many blockchains are open to forensic analysis which can lead to deanonymization and the unintentional revelation of private financial information, especially when blockchain data is combined with other data.

Because blockchains are decentralized or third party networks which are not controlled or operated by Parcent or its affiliates, we are not able to erase, modify, or alter Personal Data from such networks.

By using the Website, Mobile App and Services, you signify your acceptance of this Privacy Policy. If you do not agree to this Policy, please do not use our Services, Website or Mobile App. Your continued use of the Services following the posting of changes to this Policy will be deemed your acceptance of those changes.

Data storage period

After terminating business relationship with User, Parcent will keep data for at least 10 (ten) years upon terminating the business relationship and closing User Account, as prescribed by Czech Act No. 253/2008 Coll. dated June 5, 2008 on Selected Measures Against Legitimization of Proceeds of Crime and Financing of Terrorism.

Right to file a complaint with a Supervisory Authority

If any User believes that his Personal Data were processed contrary to the requirements of laws and regulations, you may file a complaint with the Czech Supervisory Authority – Office for Personal Data Protection / Urad pro ochranu osobnich udaju, address: Pplk.
